Online Agreement  

Both parties understand the agreement via online web page.

Before Wedding Meeting 

Within two weeks of the wedding date, we required the clients to meet for better preparation, planning, logistic and timing.

Teamwork

As videographers/photographers we want to get the best of your wedding. Cooperation and communication are to important components for getting excellently done.

Difficult Guests 

Client agrees to give the videographer/photographers the precedence over the guests to film and capture the content required.

Delivery

All video will be shot in HD or UHD. Deliveries will be made as via online cloud. If required to ship the DVD to client destination, client should cover all shipping and handling costs. The final wedding video will be delivered within or before 6-8 weeks of the wedding.

Restrictions

Note the videographers/photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done for example, venues may restrict the use of lights or limit access to locations. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.

Services Hours

ACOSTA MEDIA will be on labor on all hours booked. If for any reason, at some point it is late and additional work hours are requested, they will be billed.

Food/brakes

Our team will be allowed one 20 minute brake at their own discretion, and bathroom breaks when necessary. Each videographer will be provided a full guest meal for weddings lasting longer than 5 hours.

Copyrights

Clients acknowledge that all work created under this agreement is the intellectual property of the videographers who shall retain the copyright to the footage.

Clients may post the video online and agree not to digitally manipulate the Work. Any use of the video in featured publications or websites must be accompanied by credits to our company.

Model Release

The clients grant the videographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the video of the clients for editorial, competition, social media, advertising and any other purpose and in any manner and to alter the video or photo without restriction. The clients hereby release the videographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

Equipment

If some some reason, equipment got lost, broke or damage thanks to guest irresponsible actions, client agree to cover all reparation or replacement cost.

Changes

Final products can be light detail changed, if client requests big changes like sequence changes or others, client agree to be charged for a Changes Fee of $150.

Limitations of liability

While the videographer takes the utmost care with respect to shooting, editing and delivering the video, in the event that the video becomes lost, stolen or destroyed, for reasons within or beyond the control of the videographer, liability is limited to a refund of retainer and payment received. The limit of liability shall not exceed the contract price stated herein. ACOSTA MEDIA will not be held responsible for any ruined video footage due to guests and/or other vendors, or outside of ACOSTA Media team control.

In the event that ACOSTA MEDIA is unable to video the wedding due to: illness, emergency, accident, or Act of God, every effort will be made to find a suitable video replacement. If a replacement is unavailable, the payment made to ACOSTA MEDIA will be refunded in full, and return of the payment shall be the entire obligation under this Agreement. No other damages or guarantees of any kind are recognized or warranted.In the event that the client reschedule the wedding/event and ACOSTA MEDIA is able to rebook the original wedding/event date, ACOSTA MEDIA will amend the wedding/event date in this agreement and client will receive credit for all monies paid up to the date client(s) requests the wedding/event be rescheduled.

In the event that the client(s) reschedule the wedding/event and ACOSTA MEDIA is NOT able to book the new wedding/event date, client(s) will forfeit the Reservation Deposit, but receive credit for all other monies paid.

In the event that the client(s) cancels the wedding/event outright, Client will forfeit all monies paid up to the date client(s) notifies ACOSTA MEDIA that the wedding/event is cancelled. Cancellation must be in writing (print or email) even if a phone call was made to inform ACOSTA MEDIA of the cancellation.

Booking Fee/Deposit 

In the event of the Clients cancelling the wedding for whatever reason a booking fee of $200 is non-refundable.

ACKNOWLEDGEMENT OF AGREEMENT

Contract incorporates the entire understanding of the parties. Any modifications of this agreement must be in consent by both parties. To confirm your booking and acknowledge acceptance of all terms and conditions

 

Events

Agreement 

This agreement contains the entire understanding between ACOSTA MEDIA and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, agreeded by both parties

Reservations

Upon your agreement and payment, ACOSTA MEDIA will reserve the time and date booked, and will not make other reservations for that time. For this reason, the a 25% of full service cost will be non-refundable if event cancelled for any reason, including acts of God, fire, strike, and extreme weather. If event is re-scheduled and this date is available for book, service will be rescheduled without any additional cost.

Pre-Event Consultation 

The parties agree to a pre-event meet consult before the Event in order to finalize the actual shooting times, locations, and Client’s request list (in writing) for specific photographs or takes. The Client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired. The Photographer/Videographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs.

Shooting time/Additions

The photography/filmmaking schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and ACOSTA MEDIA agree that cheerful cooperation and punctuality by all event participants are therefore essential to that purpose. Shooting commences at the scheduled start time. ACOSTA MEDIA will not be held responsible if the event does not start on time.

 

House Rules

The Photographer is limited by the guidelines of event officials and/or event location site management. The Client agrees to accept the technical results of their imposition of ACOSTA MEDIA. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; the ACOSTA MEDIA will offer technical recommendations only.

Model Release

The Client hereby grants to ACOSTA MEDIA and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs or films of the Event, its guests, attendees, and officials for editorial, trade, advertising, stock, commercial and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases to ACOSTA MEDIA and his legal representatives and assigns from all claims and liability relating to said photographs or videos.

Exclusivity

If the Photographer/Videographer is the sole camera men at the event, it is understood that the Photographer/videographer will be the only one allowed to photograph or take videos professionally the event. In which case, amateur photographers may take photos during the event if they do not interfere with the contracted Media Team and are not shooting our same posed shots. If a problem arises with any guest or attendee(s) the On-site Event Contact will be advised to handle the situation politely for the photographer by enforcing the conditions of this agreement.
